Who’s Going to Pay for That?!

I hope everybody living here in Hampton Lakes knows that we are in a mandatory HOA membership community. In fact, we have two HOAs we belong to. The Hampton Lakes Community HOA and the Amenity Center HOA. These HOAs were initially incorporated way back in 2005. The developer back then went bankrupt with the housing crash of 2008. The new and current developer took over some time after that. At this time the developer is still in control of the HOAs because the threshold of how many houses are built has not been met. However, there is also a clause in the bylaws that states no matter what the status of the build out is, the HOAs get turned over to residents in 20 years. That makes 2025 a pivotal year in our lives because that means we are responsible for shortfalls in the budget, not the developer!

So in my opinion we have three years to get this place in tip top shape and to make sure the developer turns facilities over to us that are in tip top shape to begin with. We don’t want to be taking over anything that’s falling apart! To that end, I’d like to point out a few things and I have questions about other things too. Here we go.

  1. Who is going to own River Hall Pkwy? Is the county and/or state going to maintain that road up until the gates? Roads after the gates are the usually the property of the HOAs and are usually maintained by the HOAs.
  2. What happens to the building and parking lot that are up by the intersection of 80 and River Hall Pkwy? That has the HOA office in it now and a sales office for the builders. Does it belong to the HOAs? The HOAs split the costs?
  3. The construction entrance to Cascades is beating up the sidewalk. Who is going to fix the sidewalk?
  4. A lot of street lights are crooked. Who is going to fix them?
  5. The pool needs maintenance. It would be nice to get those things fixed before being turned over.
  6. Does the Amenity Center building need any major repairs?
  7. Who’s in charge of straightening out mailboxes? The two homeowners, or the HOA?
  8. Who’s going to pay to heat the amenity center pool? The developer just built a heated pool with restaurant/bar attached for the golf course members which are the people in River Hall. What about us poor souls?
  9. Who’s going to maintain that bell tower by 80 and River Hall Pkwy?
